Faycal Manz, a German national, filed the complaint in October 2024 against Los Tacos No 1, alleging he experienced unpleasant symptoms after eating tacos with salsa at the restaurant's Times Square location in August 2024.
The lawsuit sought damages related to the spiciness of the sauce served at the popular taqueria chain. Manz claimed the hot sauce caused him physical discomfort during his visit to New York City.
Los Tacos No 1 operates multiple locations in New York City and is known for serving Mexican-style tacos and salsas. The Times Square location where the incident allegedly occurred is in one of the city's busiest tourist areas.
The federal judge's dismissal of the case means Manz will not receive the monetary damages he sought. Court documents did not specify the exact reasoning behind the judge's decision to dismiss the lawsuit.
